WHAT TO DO WHEN YOUR PREVIOUS EMPLOYER REFUSES TO ATTEND TO YOUR REFERENCE ENQUIRY

Hello Sirs,

I would like to know what options are available to me; one of my past employers refused to attend to my reference enquiry.

As stated on your site, I know that HR issues are better resolved interactively and that you may need to ask a few questions to get the whole picture but I am constrained to use this medium when I could not reach you on phone and I do not have Jarus’ mobile number anymore.

Please note that this employer is not my immediate past employer and I do not have any disciplinary issue before I resigned. I gave one month notice and my resignation was duly acknowledged.

Their response to my current employer is that I have unresolved transactions with them despite the fact that I did a comprehensive handover note before I left and I also gave oral account of my stewardship.

Your professional advice, especially from HR perspective would be greatly appreciated.

Dear James,
The issue you presented is not detailed enough, of the nine lines you use to present your case, only one line was used to state the main issue.
Answers to the following questions should however be able to assist:
1. Do you have an acknowledged copy of your resignation letter and your clearance documents showing that you were cleared from the said employer?
2.Do you have a copy of your hand over documents signed by your reliever or someone in the said company?
3. can you approach the person in charge of the reference check in your new organization?
If your responses to the above questions are yes, you can:1. Walk up to the HR person in charge of the reference check and present the documents to him to justify your clean exit from the organization.

2. You can also write the said employer formally asking them to reply the reference check if you are sure they will not victimize you for resigning from there (because some funny employers do that). otherwise don’t go through them again, just prepare your new employer’s mind to the possibility of negative response from them and suggest a way to get the true picture of your stewardship and exit from them, by giving the contact of a senior management staff of the former employer that can present you objectively to the new employer.
3. Finally, depending on how structured your new company is: you can also write the HR formally, stating your suspicion in the reluctance with which the former employer is treating the reference check and state in the letter that you should be given a fair hearing should there be any negative remarks from your former employer. PLEASE be mindful how you draft this so that you will not send a wrong message of (guilty conscience) to the new employer. If possible, just write to suggest another avenue to get the reference check e.g through your Direct Supervisor then, etc.
